Second — The Developers Mart

1. Acceptance of Terms

By accessing or using the Second marketplace platform, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use our services.

2. Description of Service

Second is an online marketplace that facilitates the buying and selling of digital codebases between verified users. We provide the platform, escrow services, and transfer tools, but are not a party to transactions between buyers and sellers.

3. User Accounts

You must create an account and complete identity verification (KYC) to use our marketplace features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Listing & Selling

Sellers must have the legal right to sell any codebase they list. All listings must pass our 5-gate verification process including identity check, code audit, IP declaration, escrow lock, and transfer readiness. Sellers agree to the IP declaration at listing time.

5. Bidding & Buying

All bids are binding commitments. If a seller accepts your bid, you are obligated to complete the purchase. Buy Now purchases are immediate and final. All payments are processed through our RBI-compliant escrow system.

6. Escrow & Payments

All transactions are processed through our Cashfree nodal escrow account. Funds are held until the GitHub repository transfer is verified complete. Second charges a platform commission on successful transactions.

7. Intellectual Property

Sellers warrant that they own all intellectual property rights to listed codebases. Second performs plagiarism scans via Copyleaks but makes no guarantee of IP purity. Disputes are resolved through our arbitration process.

8. Prohibited Conduct

Users may not: list stolen or plagiarized code, circumvent the escrow system, create fraudulent accounts, manipulate bidding, or use the platform for any illegal purpose.

9. Limitation of Liability

Second provides the marketplace platform 'as is.' We are not liable for the quality, legality, or safety of listed codebases. Our total liability shall not exceed the commission earned on the disputed transaction.
